Jodi Latuszek wins QDRO appeal. In Joyce v Joyce (Docket No. 281175), the COA held that the trial court correctly allowed modification of the JOD where it concluded that the parties made a mutual mistake. Although opposing counsel argued that the amendment violated the rule in Quade v Quade, the COA agreed that Quade did not preclude relief under MCR 2.612, upon a finding of mistake. In this instance, the mistake arose out of confusing language regarding GM retirement supplements versus retirement subsidies.
